Seattle Seahawks running back Marshawn Lynch is preparing to take his DUI case to trial, but the court date likely will postponed from Dec. 27, attorney Ivan Golde said.

“It’s likely we will get this postponed until after the Super Bowl,” Golde said Tuesday. “There are some discrepancies in the case and it is a very low blood-alcohol DUI. In the end, it will be Marshawn’s decision about how we proceed, but as of now, we plan to take this to trial.”

As it stands, the trial date comes on a Friday, two days before Seattle’s regular-season finale against the St. Louis Rams at CenturyLink Field. Golde said Lynch does not need to be present when a continuance is requested.

Lynch, 27, was arrested in the early morning on July 14, 2012, by the California Highway Patrol after a police officer allegedly observed him driving north on Interstate 880 in Oakland, weaving in and out of lanes in a white Ford van and nearly colliding with two cars.

Golde said Lynch recorded a .08 blood-alcohol level on the field sobriety test, the lowest level that is above the legal limit. Lynch was taken to the Alameda County Sheriff Department’s North County Jail in Oakland, where a second breathalyzer test recorded a .10.

“The officers in this case have changed their version several times as to what happened,” Golde said. “They have covered up evidence in the case.”

Depending on the outcome, Lynch could face a suspension from the NFL. Golde said that will be factored into any decision they make.
